This Privacy Notice and Terms of Service explains our collection, use, and disclosure of personal information and liability.  This Privacy Notice and Terms of Service applies to Elite Kauai Car Rental, Inc., United States (US) ("we," "our" or "us"). 

This Privacy Notice and Terms of Service applies when you access or use our website, mobile application (if applicable), that link to this Privacy Notice, become an Elite Kauai Car Member (also known as EKCAR Member), contact our service team, or otherwise interact with us (collectively, the "Services").  This Privacy Notice and Terms of Service does not apply to any products such as vehicle rental, affiliate companies (if any), mobile applications (if any), or services that may display or reference a difference private policy and terms of notice or policy.

PERSONAL INFORMATION WE COLLECT

The personal information we collect depends on how you interact with us, the Services you use and request, and the choices you make at the time of contact.

Any information you may provide directly to us at the time of contact, for example:

• Contact information.  We collect name, username, your email, home address and contact phone number.
• Identification EKCAR Member information. If you are an Elite Kaua'i Car Member, we may collect identity information such as your Driver's License information, Home Address, and Date of Birth to verify membership in the "Club."
• Demographic Information.  We may request that you provide demographic information and age.
• Payment Information.  As a member and for rentals, we will require payment information for such financial transactions. We collect payment credit card numbers, billing information to include address and other payment details.
• Identifiers and Device Information. When you visit our internet-based Services or use our app (if applicable), our web servers automatically log your Internet Protocol (IP) address and information about your device, including any unique device identifiers (such as MAC address); device type; and your device's operating system and version, browser type and language, and other software including type, language, settings, and configuration, and mobile network information.  As further described in the Cookies, Mobile IDs, and Similar Technologies section below.
• Primary Member Accountholder.  When a Primary EKCAR Member adds additional household members to their membership, we will collect demographic and personal information for these household members to identify them.
• Information Concerning Minors. Elite Kauai Car Rental Inc. does not direct any services to any individuals under the age of 18. We do not knowingly collect information from individuals under 18 except as provided to us to make travel arrangements for car rental reservations as part of our legal or risk management inquiries. 

COOKIES, MOBILE IDs, AND SIMILAR TECHNOLOGIES

We, and our analytics and advertising providers, use cookies, pixels, web beacons, mobile analytics, and advertising IDs (collectively, "digital tracking technologies").  We use digital tracking technologies provided by other third parties by online services to collect information (such as cookies stored on your browser), the advertising identifier on your mobile device, or the IP address of your device), when you visit our site (or use our app if applicable).  Other third parties may use these technologies to collect personal information about your online activities over time.

You can opt out of digital tracking technologies for targeted advertising and third-party marketing purposes.

Please remember even after you have opted out of all digital tracking technologies online or any advertising, you may still see adds on the internet.  Furthermore, Elite Kauai Car Rental, (EKCAR), is not responsible for any content provided by this or any third party at any time, including this to which you could be redirected to.

You are subject to the Privacy Policy, Terms of Service and Terms & Conditions of the destination site(s) collecting your information, rather than those of Elite Kauai Car Rental, Incorporated.

OUR USE OF PERSONAL INFORMATION

We use the personal information we collect for purposes described in this Privacy Notice or otherwise disclosed to you.  For example, we use personal information for the following purposes:

• Delivery of Vehicle and Services.  To provide service of vehicles, improving personalized services, troubleshooting.
• Business Operations.  To operate our business by maintaining, creating, and continuing to improve client relationships through memberships, advertising, coupons, securing our systems, detecting fraudulent or illegal activity, analyzing competitive market trends, usage and activities with connection with our Services.
• Product and Business Development.  Develop and improvement of online features, products, vehicle line expansion, research and product development.
• Marketing & Customer Advertising.  Communicate via mail and online with you about EKCAR and affiliate company products and services, offers, contests, coupons, rewards, package deals, upcoming events, and additional information about our products and any services and those possibly offered by affiliate companies, and to display their advertising to you.
• Legal, Security & Safety Reasons.  For legal, security & safety reasons, such as to protect our rights and the rights of our members and customers, enforcement of policies, communicate safety notices, detect, investigate, or prevent fraud and or other illegal activities, or address legal and regulatory compliance obligations.
• We may combine information that we collect from different sources to give you a consistent and personalized experience at the time of delivery and service.

OUR DISCLOSURE OF PERSONAL INFORMATION

We disclose personal information we collect to complete your transactions, fulfil and provide your Services or any inquiries you have requested or may have authorized.  For example, when you rent a vehicle, we will disclose the information necessary for payment processing, fraud prevention, credit risk reduction, or other related financial services. 

Right to Not Experience Discrimination.  You have a right not to be discriminated against.

SECURITY OF PERSONAL INFORMATION

We take what we believe to be responsible and appropriate steps to help protect personal information from unauthorized access, use, disclosure, alteration, and destruction.  Unfortunately, no data transmission or storage system can be guaranteed 100% secure, and therefore we are unable to guarantee the security of your personal information. CHANGES TO THIS PRIVACY NOTICE and TERMS OF SERVICE

Elite Kauai Car Rental, Inc. reserves the right to revise the Privacy Notice and Terms of Service regarding how we utilize personal information and Services.  When we post changes to the Privacy Notice and Terms of Service, we will revise "Last Updated" date at the top of the Privacy Notice.  If we make material changes (if any are applicable), to the Privacy Notice, we will provide notice or obtain consent regarding such changes as may be required by law. Your continued use of this site after the date constitutes your agreement to the revised modified Privacy Notice and Terms of Service.

LIMITATION OF LIABILITY FOR USE OF THE SITE AND LINKED SITE(S)

The information, software, products, and description of services published on a site or linked site (if applicable), may include inaccuracies or typographical errors, and Elite Kauai Car Rental, Inc., specifically disclaims any liability for such inaccuracies or errors. Elite Kauai Car Rental, Inc., does not warrant or represent that the content on its site is complete or up to date. Elite Kauai Car Rental, Inc., is under no obligation to update any content on its site.  Elite Kauai Car Rental, Inc., may change the content on its site at any time without notice.  Elite Kauai Car Rental, Inc., may make improvements or changes to its site at any time. 

EKCAR, its affiliates and any of their respective Officers, Directors, Employees, or Agents will not be liable, whether in contract, tort, strict liability or otherwise, for any direct, punitive, special, consequential, incidental or indirect damages (including without limitation lost profits, cost of procuring substitute service or lost opportunity) arising out of or in connection with the use of its site or a linked site (if applicable), or with the delay or inability to use the site.  This limitation on liability includes, but is not limited to, the transmission of any viruses, which may infect a user's equipment, failure of mechanical or electronic equipment or communication lines, telephone or other interconnect problems (e.g., YOU CANNOT ACCESS YOUR INTERNET SERVICE PROVIDER), unauthorized access, theft, operator errors, strikes or other labor problems or any force majeure.
